The Bochum Regional Court recently made an important judgment concerning the company ABUS, a well-known manufacturer of security technology. The court has ordered ABUS to inform its customers much more comprehensively about security gaps in certain door and window locks. This decision underscores the growing legal and ethical responsibility of companies to provide transparent information about product defects, especially when they may affect consumer safety.

The ruling by the Bochum Regional Court is based on a lawsuit by the Federal Association of Consumer Organizations (vzbv), which had criticized ABUS' information policy. The focus of the criticism was a security gap in the “HomeTec Pro CFA3000” wireless door lock drive. Despite a warning from the Federal Office for Information Security (BSI) in August 2022, which indicated a “high” risk level, ABUS limited itself to information on the product description pages of its website. The court assessed this measure as insufficient to provide adequate consumer information.

The ruling also has an impact on retail. Retailers who continued to advertise the affected products with a test result from Stiftung Warentest that has since been withdrawn were also warned by the vzbv. Two dealers then issued a cease-and-desist declaration, and another case ended up before the Mannheim regional court, which also ruled in favor of the vzbv.

These rulings underscore the need for clear and comprehensive communication about product safety. Consumers make purchasing decisions based on the information available to them. The court rulings underline that consumer safety must not take second place to commercial interests. This is particularly critical when it comes to products that directly affect the physical safety of users, such as door locks.
