Who is liable for accidents involving pets?

As a rule, the owner is liable for damage caused by an animal - even if he is not at fault. The law assumes that animals are unpredictable and therefore pose a danger: so-called strict liability applies. Even if a third party looks after a pet as a favor and it causes damage, the owner is usually liable.

Which insurance pays what?

Private liability insurance usually covers damage caused by small animals such as cats, guinea pigs or rabbits. For larger animals, such as dogs or horses, you need special pet owner liability insurance. However, this does not pay if the owner suffers damage and it does not cover any costs incurred by the police or fire brigade.

Anyone who keeps farm animals is only liable for damage if they have breached their duty of care. Nevertheless, most businesses with animals have business liability insurance, which also includes damage caused by farm animals.

Noisy animals

The police can impose fines for serious violations of quiet regulations. Anyone who has the feeling that limit values ​​are being exceeded can request a volume measurement from the municipality. As a tenant, I may be able to reduce the rent if noise disturbances persist. Before doing so, the tenant should seek legal advice.

Animal burial

Deceased pets may be buried in your own garden, provided it is private property and the animal is buried under 50cm of soil.
In addition, there should be no water protection area and the animal must not have any diseases. Alternatives include animal cemeteries, animal crematoriums, or animal carcass disposal facilities. It is also possible to bury the pet and owner in the same grave.
