The Basic Law (GG) is the constitution for the Federal Republic of Germany. It was decided by the Parliamentary Council, whose members were elected by the state parliaments, on May 8, 1949, and approved by the Allies. It consists of a preamble, basic rights and an organizational part. The essential state system and value decisions are laid down in the Basic Law. It ranks above all other German legal standards.

When the Basic Law was promulgated on May 23, 1949, it was basically just a kind of emergency building to “give state life a new order for a transitional period”. Nobody seriously suspected that it would still be valid for over 70 years, as it was assumed that the division of Germany would only apply for a very limited time, after which a “real” constitution would be created.

This is also the reason why the Basic Law, which has the character of a complete constitution due to its extensive regulations, does not also have the name “Constitution”: It was originally only intended to serve as a transitional period, but to be a legal basis, a basic law . A special character that characterizes the GG as a comprehensive constitution.

It regulates not only the rights of the state organs, but also those of the individual, which is made clear right at the beginning with Article 1: “Human dignity is inviolable” . And this refutes the claim that the Basic Law is not a constitution and that it still needs to be determined: Yes, it is a constitution, it just doesn't have that name for historical reasons! And that has been the case for over 70 years.

Many conspiracy theories about the Basic Law

It is repeatedly falsely claimed that the Basic Law is invalid, that the Federal Republic of Germany does not exist and that the government is also unconstitutional . These are all statements that we have had to deal with again and again for years. Based on these ideas, there were of course the wildest statements and theses that were spread on social media.
