Can I send songs on my smartphone to friends, e.g. via Bluetooth or WhatsApp? Yes, under certain conditions.
As our cooperation partner checked4you reports, the ultimate question is what you know about the file (e.g. mp3, flac, wav, m4a).
If you don't know where the song comes from, it could have been downloaded illegally. And then you might not be allowed to pass it on – the matter would remain legally uncertain.
In practice, this point may not always be clear: someone gives you the song, got it somewhere else, etc., who wants to trace the chain of rights? Then the simple rule is: you don't know exactly whether it's still legal and you shouldn't pass the file on.
Do you own the music on a storage medium such as a purchased CD? You can then make private copies if the CD is not copy-protected and pass them on to friends. However, only to some - courts used to often assume up to seven copies.
With digital music titles, such as downloads from music platforms, the whole thing is more complicated. Here the providers often exclude the distribution of music files in their terms and conditions.
There is currently no judicial clarification as to whether this is permissible. That's why the same applies here: It's better not to pass it on!
