Data protection rights in the EU are being renewed. There are a lot of rumors about this – and strange status posts on social networks.

We already reported on the “I hereby contradict the GDPR…..” image on May 14th. 2018 reported. Now our cooperation partner from “checked4you” has also published something about it.

If something changes on Facebook, texts or images will soon float through the social network with which you can supposedly object to the changes. This is also happening with the new General Data Protection Regulation (GDPR). This is the new data protection law, which will apply in all EU countries from May 25th and is currently causing a stir and many rumors.

In a graphic that we found, the text reads: “I hereby object to the GDPR (General Data Protection Regulation) and can therefore continue to post photos of people on Facebook. Share this so that you can do the same from May 25, 2018, otherwise penalties of up to €20 million are possible.”

This is about the much-discussed topic that supposedly the GDPR means you are no longer allowed to photograph people and show them on the internet. But that has been the case in Germany for a long time! This is called personal rights or the right to one's own image.

You cannot contradict the GDPR

And if texts are now being spread on Facebook that supposedly contradict the GDPR and continue to show photos of people, then that is simply nonsense. Individuals cannot object to the GDPR, nor can you publicly show other people in photos without their consent. And be careful: Even if you limit the visibility of such an image on Facebook to only certain people, it can count as publication!

So always remember: If you take a photo of someone and want to show this photo somewhere on the Internet, the person being photographed usually has to agree to it! Otherwise, she can actually sue you for violating her privacy rights.

The creator of the graphic contacted us directly and pointed out the fake. This is a photo producer who CONSCIOUSLY put this image into circulation!

Why he did that?

He himself found a picture on Facebook, which we also reported on. It was about the sharepic “ Warnings for publishing photos of people !” It was already clear to him at the time that this was nonsense and he had the idea of ​​making fun of it with one of those typical “I object to the terms and conditions…” images. He posted this picture on his Facebook page to see what happens next! In an article he published on this topic on his website, he wrote:

Some of my photo-savvy and copyright-savvy Facebook friends shared the image because they got the inside joke and found it as funny as I did. But the joke soon developed its own dynamic

In other words: He deliberately created and shared a “fake”!

And he is ashamed of that and writes:

I am now somewhat ashamed of having played my part in spreading untruths and uncertainty into the world.

However, he also learned something from it and we can only agree with him:

On the other hand, I learned an important lesson :
If I manage to produce fake news that is seen by almost a third of a million people within a minute without much thought, then what can people who intentionally and plannedly produce lies and propaganda achieve? want to spread in order to influence people, direct them or manipulate elections?

That's why I ask you: Check the facts, don't believe every bullshit and only share information if you can trust the source. Before sharing, maybe read mimikama.org, where many viral false reports are debunked.

On May 16, 2018, he informed his users about it on his Facebook page and told his fans that it was fake.

Do we think that's good?

Yes and no! On the one hand, it's true that you can see how unthinkingly thousands of users simply share an image like that. In this case, not much will happen, it will just be an annoying “chain letter” that we will probably see again and again on the Internet for years to come. On the other hand, we are against CONSCIOUSLY misleading users, because as the saying goes? “A little bit of dirt always gets stuck.” In other words: The FAKE itself will always reach more users than the educational report on it, regardless of whether it is his own or the one we have just written here.
