The rapid development and spread of artificial intelligence (AI) threatens the already often very precarious financial situation of creative professionals. At least that's what a number of artists in the USA believe, who are now retaliating and have jointly filed Stability A I and Midjourney The accusation: Their tools violate the rights of “millions of artists” by using their works without their permission.

“Harms the market and artists”

“A trio of artists have launched a lawsuit against Stability AI and Midjourney, the developers of the AI-powered art generators Stable Diffusion and Midjourney, and the portfolio platform DeviantArt, which recently introduced its own AI generator, “DreamUp,” writes “The Verge”. The three initiators – Sarah Andersen, Kelly McKernan and Karla Ortiz – believe that the tools violate intellectual property rights because they were trained with five million photos from the web without first obtaining the consent of the authors of these works.

“This is another important step in making AI fair and ethical for everyone,” emphasizes author, designer and lawyer Matthew Butterick , who will represent the prosecution in this case together with the law firm Joseph Saveri Law Firm : “AI tools like 'Stable Diffusion' have the potential to flood the art market with an unlimited number of copyrighted images. This harms both the market and the artists themselves.”

Danger to livelihoods

The fact that the use of AI software has gained popularity is a thorn in the side of many creative professionals. While some believe that such technical aids could be helpful, many others are extremely critical of the development. They are convinced that these tools not only violate applicable law, but also pose a serious threat to their already often modest economic livelihood.

In the case of this lawsuit, the artists are particularly concerned about the fact that AI systems in the art sector are often trained with billions of images from the Internet. Since no consent is obtained from the intellectual authors during this process, they have no idea what happens to their works and do not receive any financial compensation.
