Tightening of copyright law! What if you don't really stick to something that you propagate? Karsten Schmehl from Buzzfeed investigated this question.
This is about ancillary copyright law or the tightening of copyright law at EU level. Basically, copyright is a good thing, as it protects every author (like me, for example, as the author of an article). However, the guidelines for the new ancillary copyright law received a lot of criticism ( we reported ).
On September 14, 2016, the proposal for a directive of the European Parliament and the Council on copyright in the digital internal market was presented to the Council by an EU Commission. The proposed directive is one of the Commission's initiatives under the Digital Single Market. The introduction of ancillary copyright law in the EU was largely driven forward by Axel Voss (CDU).
It is now clear: At least the highly controversial point “upload filter” is now off the table. This means that at least these digital filters, which have worked incorrectly in the past and prevented unauthorized content from being published, are no longer applicable. Incidentally, to the regret of Axel Voss, who also announced this in the media.
“I regret that the majority of MPs did not support the position that I and the Legal Affairs Committee took.”
What you don't want to be done to you...
Now Buzzfeed's Karsten Schmehl took a closer look at Axel Voss' Facebook page and asked himself... did he or didn't he? Schmehl found at least 20 images for which you have to purchase license rights on various portals or from different authors. Was this official Facebook page (not the private profile!) used content that would be illegal after Article 13 comes into force?
Schmehl asked about these pictures and presented a correspondence that was still open but interesting:
Were these stock photos licensed and purchased for use on Axel Voss’ social media channels?
If so, could you please provide me with evidence of this?
If not, why not?
There has now been a very interesting reaction on the politician's Facebook page: 12 of the 17 photos on Axel Voss' Facebook page that @BuzzFeedNewsDE about His office's statement to Buzzfeed: "Every user can upload and take down posts on Facebook as they please."
The entire correspondence and the 20 images to be licensed on Buzzfeed (Karsten Schmehl) : “EU politician Axel Voss uses copyrighted photos on Facebook and doesn’t tell us whether he paid for them.”
