At the beginning of August 2022, the Bavarian Cybercrime Central Office brought charges against two suspected members of the management level of an internationally operating gang of investment fraudsters. This was preceded by extensive investigations together with the Ansbach Criminal Police Inspectorate, which led to the identification of the two 28-year-olds and 31-year-old Israeli citizens.

Cyber ​​trading scams

The indictment accuses the two defendants of commercial and gang fraud in the form of so-called cyber trading as well as participation in a criminal organization as ringleaders. You have to answer before a commercial criminal division of the Nuremberg-Fürth regional court.

From mid-2017 and mid-2020, the accused are said to have been part of an internationally operating and professionally organized group of perpetrators in a high-ranking position, which had come together to continuously commit fraudulent acts in the form of fraudulent cyber trading.

The perpetrator group also operated on numerous domains, including the trading platforms Alpha Financial Group, Geneva Capital Group and Zurich Financial Group, which are very successful on the German-speaking market. In any case, a call center has been maintained in Bulgaria since mid-2017, from which numerous victims were persuaded to make alleged investments in various financial products.

In the process, extensive operational measures were taken in Bulgaria in July 2021 on the initiative of the Bavarian Cybercrime Central Office and the Ansbach Criminal Police Inspectorate. For details, please refer to the press release dated August 9, 2021 (PM 16/2021). One of the men now accused was among the suspects arrested at the time. He was extradited to Germany in early 2022.

According to the results of the investigation, the accused are said to have worked as the so-called CEO of the call center until the call center was searched and were extensively involved in its organization and management. Based on the well-known complaints from German and some Austrian victims, the accused are said to be responsible for damages of over 14 million euros and over 8 million euros respectively and have themselves received six-figure proceeds from the crime.

Since Action Day, several other people involved in the crime have been arrested in the entire complex. There are already the first convictions obtained by the ZCB in Germany. Two accomplices, who were also arrested in Sofia in July 2021, received total prison sentences of 4 years, 6 months and 4 years, 2 months respectively after they were extradited to Germany and charged in May and August 2022 after making full confessions in two separate trials sentenced. The judgments are legally binding. In this context, reference is also made to PM 5/2022, although the proceedings mentioned there before the Youth Chamber of the Munich I Regional Court have not yet been completed.

A commercial criminal division of the Nuremberg-Fürth regional court must now decide whether to admit the charges and open the main proceedings. The law provides for a prison sentence of one to ten years for commercial and gang fraud.
