The NetzDG has now been revised. Social networks are obliged to forward hate speech to the authorities. However, there are concerns about this.

In December, Federal Justice Minister Christine Lambrecht (SPD) presented a draft for the NetzDG. It requires Facebook and other social networks to report hate speech, such as death threats on their pages, to the authorities. In order to be able to track down the authors behind the hate messages, authorities should have access to users' passwords.

What does the NetzDG include?

The Network Enforcement Act regulates the increasing spread of hate crime and other criminal content, especially in social networks. The operators of the networks are thus obliged to check illegal postings and comments and to remove them or block access to them in accordance with the NetzDG.

Lambrecht has now responded to the criticism and revised the NetzDG. Facebook and Co are only allowed to pass on user passwords to the authorities in the event of the most serious crimes. This does not apply to administrative offenses, for example. In addition, a judge must always approve such a release.

It was known that death threats and comments or postings containing right-wing extremist propaganda had to be reported. In addition, the threat of sexual violence now also has to be reported. If someone threatens a Facebook user with rape, the punishment can be up to three years in prison.

Greens and prosecutors skeptical

Konstantin von Notz from the Greens criticizes the fact that many questions remain unanswered. “For example, how the Federal Criminal Police Office should deal with the extremely large flood of expected reports. The best legislation is of no use if the judicial system is not improved.”

Prosecutors also warn of the threat of overload.

“If you know that a very hard-working public prosecutor can handle around 1,000 cases a year, then you can calculate quite precisely how much effort will be incurred by the judiciary,” says Senior Public Prosecutor Markus Hartmann, head of the Cybercrime Central Office in Cologne .
