A new phenomenon is currently being observed by the police. This is what is known as “Facebook hacking” or “Facebook phishing”. The perpetrators “hack” the person’s account or take it over through phishing. Access for the account holder to their own Facebook account is usually no longer possible shortly afterwards.

The perpetrators then post child pornographic content via the affected account. After the Meta Group (responsible for Facebook) discovers this content, the affected accounts are blocked and reported in accordance with legal requirements. If the account holder tries to log in to their account, the following display appears:

Access for the account holder is no longer possible.

What's behind it?

The LKA Lower Saxony has been processing the so-called NCMEC procedures . The term NCMEC means National C enter for Missing & Exploited Children . The NCMEC is a semi-governmental organization in the USA. US providers are required by US federal law to forward criminal law-related matters to the NCMEC. If account holders in another country are affected, the knowledge gained there is transmitted abroad from there.

If Germany is affected in a case, these tips will first be received by the Federal Criminal Police Office, processed there and then made available to the federal state in which the account holders are based. For Lower Saxony, these findings are received by the LKA Lower Saxony. This working method described is carried out analogously in the other federal states via the respective state criminal investigation office.

For the affected account holders, this means that the police have been informed of a crime (possession or distribution of child or youth pornography) and they will be recorded as defendants in criminal proceedings because the relevant content was posted via his/her account . The responsible public prosecutor's office usually discontinues such cases because there is no involvement of the account holder in question, but such constellations can still be unpleasant for those affected.

You can find a contribution including an interview with the Vice President of the LKA Bernd Grundel from August 12th, 2022 on “ Lower Saxony 18:00” here . (From around minute 7:20)

In the last four months alone, a number of such cases in the mid-three-digit range have been identified and processed. The exact target from the perpetrator's perspective has not yet been clearly determined. Possible acts of blackmail with financial demands by the perpetrators may play a role before or after such acts. Damaging the reputation or discrediting those affected in public is also a possible motive.

Notes on the behavior of affected Facebook customers:

In general, it is important to keep password current and secure The so-called two-factor authentication (2FA) has also proven to be helpful against unauthorized access by third parties. Using the 2FA method, an additional code is required to log in, which the user must confirm via alternative means (e.g. 2FA app/generator, code via SMS…). Only after confirming this second hurdle can the authorized user log in.

However, anyone who receives such a request on their device without having initiated it themselves should not confirm it without checking it. Perpetrators may try to “annoy” you massively and automatically until you “tired” and comply with the request without checking ( 2FA fatique attack ).

Instructions from Facebook regarding the 2FA setup can be found here: https://de-de.facebook.com/help/148233965247823

People who can no longer access their Facebook account may be . affected by the phenomenon described and should file a corresponding report with the police on suspicion of spying on data (according to Section 202a of the Criminal Code).
