Many consumers are completely unaware that contacting them is a sales pitch. Many people think that it is their previous energy provider who is contacting them or that they are being informed about new tariffs without obligation. In good faith, they provide their personal information, the current energy supplier and the meter number. The fact that this conversation initiates a change of provider is not discussed. A short time later, those affected will be informed by post, email or SMS that they have concluded a new electricity and gas contract. At the same time, they receive confirmation of termination from their previous supplier.
Many then turn to the Saarland Consumer Center for advice. V. and ask what they can do.
Tips from the consumer advice center
“In principle, you always have a 14-day right of withdrawal when concluding a contract over the telephone or at the front door,” says Désirée Fuchs, lawyer at the Saarland Consumer Center e. V. “As of July 27, 2021, the special feature of energy supply contracts outside of the basic supply is that they can no longer be concluded by telephone, but rather in text form, e.g. B. by letter, email or SMS. You should object to the foisted contract with the new provider and at the same time, alternatively, revoke it. It’s best to do this by registered mail so that you have proof of access.”
Affected consumers should also contact their previous energy provider as quickly as possible and inform them that they have not authorized anyone to terminate the contract and that they would like to continue their current contract under the old conditions.
The best protection against such unwanted changes of provider is to never reveal your personal data and meter number to unexpected callers, says Fuchs. If you want to change your energy provider, you should take the time to compare prices and check the contract conditions.
