Whether it's a one-off energy flat rate or a few euros more per month. Gyms are sometimes very creative when it comes to passing on energy costs. But is that even okay? The Lower Saxony Consumer Center explains what is allowed and what is not.
“Of course, fitness studios are also confronted with rising energy costs. But increasing membership fees for existing customers is not easily possible,” says Alina Menold, legal expert at the Lower Saxony Consumer Center, and further explains: “It depends on what and in what wording it is written in the contract. The general terms and conditions usually contain price adjustment clauses. However, those affected should look closely here.” Some formulations are not legal. Consumers can then stick to their old, originally agreed contribution.
Secret contribution increases are not permitted
In any case, the fitness studio always has to communicate an increase in contributions in writing. “So anyone who is suddenly and without prior notice debited a flat rate or even more monthly should object to this in writing and demand back the overpaid amounts, stating a deadline. If a SEPA direct debit mandate has been approved, it can also be pointed out that this only applies to the agreed amount,” says the expert.
Special right of termination in the event of unilateral adjustment
If the increase in contributions is legal and has been correctly communicated to members, those affected have a special right of termination. “Studios must also point this out in writing and set a reasonable deadline of at least 14 days,” says the expert. If they have not done so, customers do not have to pay the increase. However, anyone who makes use of their special right of termination should definitely also revoke the direct debit authorization or terminate the standing order.
