“The layperson is hardly able to recognize which fireworks exceed the maximum net explosive mass applicable to Germany,” says Ralph Madaj, a customs officer with experience in this area at the Munich Traffic Routes Control Unit. The import of fireworks that have not been assessed for conformity and do not have the CE mark is prohibited and punishable under the Explosives Act. This also applies if the CE marking is forged.

Customs therefore sees itself encouraged in one of its important tasks: protecting people and the population from possible dangers. In the worst case, the use of certain rockets and firecrackers could have life-threatening consequences for health and life.

Looking forward to the turn of the year, both control units of the Rosenheim Main Customs Office in both the greater Munich area and the greater southeastern Upper Bavaria area are currently preparing for more intensive checks with a view to compliance with the Explosives Act. Any investigation into the importation of fireworks that are not permitted in Germany poses major challenges for officials: Since they are explosives, they must be confiscated immediately and taken to a safe storage location as part of an emergency transport.

It should be noted that fireworks self-ignite under certain circumstances, which is why transporting them in a car can pose a life-threatening risk. Ultimately, criminal proceedings must be initiated regardless of the quantity imported. Experience shows that the judiciary judges rigorously and quickly in this context. Prison sentences and heavy fines are imposed. In one case, the illegal import of just 9 rockets resulted in a fine of over EUR 3,000.

“If you don’t want to endanger yourself or others and also don’t want to suffer unpleasant criminal consequences, the following applies: stay away from fireworks or firecrackers without a CE mark that are not permitted in Germany.”
