Consumers can ignore the letter and do not have to make any payment.

Households receive a letter from the Stucko law firm. It is titled “Eilt – Debt Collection Procedure” and comes from “(Müller) Rechtsanwalt”. The letter states:

Unfortunately, you have not yet settled the claim you are aware of. Please consider this letter as our last attempt to save you further avoidable costs. If we cannot determine payment to our account immediately upon receipt of this letter, we will recommend that our client initiate legal dunning proceedings against you.

Important for you:

– Our client will not accept another fruitless expiration of the deadline.

– If the legal dunning procedure is carried out, considerable additional costs will arise. If the claim is successful, these will also be at your expense. We therefore strongly advise you to pay the amount requested in this letter immediately.

– After the transfer, you no longer have any debts. The file is resolved.

You could recognize this from the following points, among others:

  • The Stucko law firm from 1080 Vienna does not exist, nor does the lawyer and public notary Dr. Thomas Müller. You can find out with a simple internet search.
  • The letter is superficial and does not contain any specific information about who you should have an outstanding claim with. This information is usually found in legal letters.
  • Although the lawyer is said to come from Austria or Great Britain (both addresses can be found in the letter), the message quotes the German Civil Code.
  • There is no indication in the message as to how you can transfer the supposedly outstanding claim to discharge the debt.
