How can you secure legal evidence using screenshots? The police give tips on this!
Screenshots are an important tool, especially when screen content changes or content that could possibly be quickly deleted. If these are also signed by time and place, it is even better. Screenshots are important.
There is a post from the Frankfurt am Main police on Facebook about preserving evidence in the form of screen recordings. The explicit aim is to secure evidence of hate crime or hate speech. The police write:
Freedom of expression is a fundamental right - hatred and incitement are not! Our job is to protect and guarantee the fundamental rights of everyone. Freedom of expression in Article 5 of the Basic Law is a particularly valuable asset and a central building block of our democracy.
Hatred, group-related misanthropy, racism, insults and defamation that aim to disparage others are not opinions.
Anyone who spreads hatred and hate speech online doesn't just harm a specific person or group of people: we all lose as a society. We cannot allow this - not us as the police and not us as a society.
We support those affected by hate speech or hate speech online if they want to report content and comments. Anyone who encounters hatred and agitation online can file a complaint at any time or report this content to hessengegenhetze.de. Legally compliant screenshots are important.
Features of a legally compliant screenshot
- Take a screenshot promptly, i.e. as quickly as possible
- The time of the comment as well as the date and time the backup was created should be visible in the screenshot.
- The account name or name of the suspected perpetrator must be visible on the screenshot.
- What does the hate comment refer to? On a post, on other people? Where was it posted? The screenshot should show the context.
A short explanation of what a screenshot should show is also available on HessenGegenHetze.de and the websites of the action program partners.
