“Smoking in the car when children are traveling has been banned since May 1st.”

Users are reading this claim again and again on Facebook at the moment - but is it really true?

Many users from Germany are asking about this because they read about it again and again on Facebook but haven't heard anything about it in the media.

It may be that you don't hear much about it in the German media, because this new law applies to Austria and not to Germany !

As the Spiegel and the ÖAMTC report, from May 1st in Austria you can be fined up to 1,000 euros if you are caught with minors and a cigarette in the car.

However, Austria is not alone in banning smoking in cars.

Similar bans also apply in other EU countries, for example in:

  • Great Britain
  • France
  • Greece
  • Ireland
  • Italy
  • Cyprus.

Even outside of Europe, you are not allowed to smoke in the car with a child in all countries. Some US states as well as Canadian provinces, Australia and South Africa also have smoking bans.

Germany is different

In Germany, however, smoking in the car when children are traveling with you is still permitted - even though surveys from 2017 show that two thirds of those surveyed would not be opposed to a ban on smoking in the car.

Result:

The statement that smoking in the car has been banned since May 1st when children are traveling with you is true. But this only affects Austria and not Germany.
