The operator wrote to consumers affected by the data leak via SMS without a legal basis and informed them of the impact. He is probably in possession of freely accessible Facebook data such as telephone numbers. In the SMS, the provider then attempts to lure consumers to the website in order to do business with you. The law firm of Dr. Stoll & Sauer briefly explains what needs to be taken into account when sending SMS:
- According to Article 6 GDPR, an SMS may only be sent to customers and contacts if the recipient has given their express consent. Consent is only not necessary under very specific circumstances - such as in the event of a disaster alarm. Consent in the data protection context means any expression of will in which a person accepts the processing of their personal data. It is important that the consent was given without coercion and only for the specific case.
- According to Art. 7 Para. 1 GDPR, there is an obligation to provide proof of consent.
- It is also important that the consent is tied to one or more purposes. The recipient must therefore be informed in advance about what their data will be used for. For example, if there is consent to use the mobile phone number for status updates of an order, no marketing SMS may be sent.
- Overall, users must always be clearly informed about the purpose for which their data is being processed, in what way, to what extent, whether their data will be passed on to third parties and when they will be deleted.
Conclusion : Since the operator of the website www.dsgvo2022.info sent SMS messages without the consent of consumers, there may be a clear violation of the GDPR. There may also be a violation of the law against unfair competition (UWG). Consumers who have received an SMS for no reason and without consent can claim damages from the operator. Dr. Stoll & Sauer considers the operators' approach to be highly questionable and dubious. According to the website's imprint, the operator comes from Markt Nordheim in Middle Franconia. However, the address does not exist there. Who exactly is behind it is therefore unknown. In any case, the operator is primarily committed to enforcing the GDPR and at the same time breaking data protection law.
