The “Smart Care Service” from United Swiss Marketing AG calls older people and involves them in conversations about home care, care levels and applications for care services with which the care service can provide support. A current case of telephone rip-off that targets particularly vulnerable people who are often unable to defend themselves.
Since last week, there has been an increasing number of complaints from consumers about a “Smart care service” from United Swiss Marketing AG, which calls older people, offers them advisory services and claims to want to support them in applying for or receiving the nursing care insurance benefits they are entitled to receive. After the phone call, you will usually receive an invoice for a “service fee” of 129.00 euros.
Old scam, new rip-off
But those called neither know where the callers got their numbers nor can they remember having concluded any contract.
“We don’t know where the callers got the consumers’ numbers from, but it is conceivable that phone books are systematically searched for older-sounding first names or that data from other rip-off companies has simply been taken over.”
Gabriele Bernhardt, lawyer at the Baden-Württemberg consumer advice center
“Whoever has been foisted with such a contract should definitely defend themselves, object, revoke the supposedly concluded contract and under no circumstances should they pay. So far we have found that revocation by email has worked well.”
On the website of the Baden-Württemberg consumer advice center, affected consumers can find a free sample letter to object to the unwanted contract.
But those affected were usually lucky enough to have relatives who took care of the matter. Those who don't have relatives who can take care of the cancellation are often left behind, are overwhelmed by the rip-off and end up paying money for a service that was never wanted.
Care service under observation
The Baden-Württemberg consumer advice center will continue to keep an eye on the “Smart care service” and examine legal steps – especially since United Swiss Marketing AG is not an unknown entity. “Bonafair AG” and “Mönchshofer AG” also operate at the same business address – companies in Switzerland that also call older people without asking, engage them in conversation and then send nutritional supplements along with a hefty bill.
