On November 24, 2022, HateAid, together with Anna Nado and the Federal Association of Women's Counseling Centers and Women's Emergency Calls, Women Against Violence, will launch a petition against the mass distribution of fake nude photos and deepfake porn on the Internet . These can be created in seconds using face swap apps that have already been downloaded millions of times.
The demands are:
1. Stop unwanted manipulation of nude photos! Use your options and prevent app providers from offering and advertising unwanted manipulations of nude photos.
2. Manipulation apps out of the app stores! Campaign to ensure that app stores no longer offer apps that enable the unwanted manipulation of nude images.
3. Stop manipulation with strong laws! We don't need new criminal offenses, but the current laws urgently need to be adapted so that they effectively protect us from the pornography abuse of our images.
Deepfake porn of politicians or actresses
These popular smartphone apps make it possible to capture any face in video footage . A simple profile photo quickly becomes a short video clip with the person's face. What initially sounds like harmless fun is, in many cases, not: Face swap apps are used, among other things, to create deepfake porn of politicians or actresses, for example Against their will, they then find their faces in hardcore porn. Studies come to the conclusion that around 90 to 95% of all deepfakes involve non-consensual pornography, around 90% of which is directed against women .

Face-swapping apps have become a tool used to specifically intimidate and silence women. Federal Digital Minister Wissing must finally act and show that the federal government structural misogyny seriously.”

The distribution of fake nude images and deepfake porn online is a form of image-based digital violence . Those affected often have to struggle with the effects for years. For example, when the recordings repeatedly appear on new platforms or are shared with the employer. With the spread of face-swapping apps, this could increase further in the future. Some of them openly advertise that they “deepfake” anyone with just one photo and have already been downloaded several million times from the app stores. Some apps even encourage people to fake nude photos, as extensive research by Spiegel and Netzpolitik.org showed just a few weeks ago. However, the current legal situation hardly reflects these developments: it still treats the distribution of nude photos on the Internet as a minor offense .
The alliance therefore demands from Federal Digital Minister Wissing:
- Stop unwanted manipulation of nude photos! Use your options and prevent app providers from offering and promoting unwanted manipulation of nude photos. Providers of such apps and other services should be prohibited from enabling the creation of fake nude photos and pornographic videos.
- Manipulation apps out of the app stores! Campaign to ensure that app stores no longer offer apps that enable the unwanted manipulation of nude images. The stores should be required to block such offers.
- Stop unwanted manipulation with strong laws! We don't necessarily need new criminal offenses, but the current laws urgently need to be adjusted. In most cases, the distribution of fake nude photos is an insult, slander or violation of the right to one's own image. These crimes are not prosecuted as less serious crimes and are too often referred to private prosecution. But if they are committed publicly on the Internet, they are not a private matter. We therefore call for them to be designed as relative offenses in these cases so that they can be prosecuted solely on the basis of public interest.
The petition runs until January 24, 2023 and will then be handed over to Federal Digital Minister Volker Wissing. Further information can be found here .
