A video from 2014 shows a boy being beaten. It's currently circulating again on Twitter and we're receiving inquiries about it again.

We again received inquiries about a video that was recirculated via Twitter. You can see a boy being pushed against the wall and beaten by a bigger boy.

The fact check for the video

The video is already older. We reported on this for the first time in March 2014. It is Christoph M. from Marl. He was cornered and beaten by the perpetrator on his way to school in March 2014. This was already known to the police. Friends of the perpetrator filmed the crime and uploaded it to Facebook.

At that time, Christopher's parents filed a complaint of assault. In September 2016, the perpetrator was sentenced to 40 hours of work and EUR 200 in compensation.

Conclusion

This is not a current case. The perpetrator was held accountable for his actions in 2016. As is so often the case, the Internet doesn't forget and the victim is repeatedly held back from agonizing minutes of his life.

General information about hate speech on the internet

On the topic of “modern witch hunts”: We also find the content of the video very bad. What happened was definitely not okay. But re-uploading the video also creates incitement.

Private profiles, site operators and groups are walking on very thin ice when they call for hate speech. Because hate speech – even online – is punishable under criminal law.

What the creators don't consider, however, is that they are committing a PUNISHMENT with such pages, groups, status posts, shares, etc.
This also applies to those users who make comments like “Let’s meet and catch this guy” etc.

A private search call can punishable . Many people are not aware of this. Some users independently publish and share wanted calls without first making sure whether it is a current case.

Note:  Only law enforcement authorities are allowed to publicly search for people.

  • Criminals, not to mention suspects or people who are not even being investigated(!), also have personal rights. Nobody can override this with their own opinion.
  • These personal rights may only be weakened under very specific circumstances. Requirements that only apply in very rare cases.
  • Children and young people also have personal rights that may not be violated by private searches (pictures of supposedly wanted children, sick children, etc.).
  • Anyone who violates the personal rights of third parties must expect expensive warnings, claims for damages and compensation for pain and suffering and may be committing criminal offenses.

Victim protection

The distribution of such videos is often done in the name of protecting victims. Victim protection – is that really the case? Does this help the victim, in this case the boy himself, when a painful minute of his life is repeatedly held up to him online?

The internet doesn't forget, it won't forget this video either. This video will therefore always bring back traumatic memories of this moment for the boy.
