Police confiscate cell phones containing child and youth pornography

During a search of the apartment, the Passau police seized numerous cell phones and data storage devices.
The public prosecutor's office is now checking whether the material was also distributed.

Due to other investigations, several people became known who are suspected of being in possession of or involved in the distribution of child/youth/violent and animal pornography images and video material. The Passau Police Department is conducting the investigation in consultation with the Passau public prosecutor's office.

At the request of the Passau public prosecutor's office, the Passau district court issued a large number of orders to search the apartments of people from the urban area and district of Passau as well as from the Freyung-Grafenau district. The background was other investigations in which the participants in a WhatsApp group were strongly suspected of possessing or distributing child/youth/violent and animal pornography.

Cell phones and data carriers secured

The searches of the apartments were carried out this Friday on the owners of the respective telephone numbers or the actual users (children and young people). Numerous cell phones and other data carriers were seized during the searches. If the evaluation reveals evidence of criminally relevant content, the devices are subject to confiscation according to the Code of Criminal Procedure and will no longer be released to the owners.

The Passau Police Department is conducting further investigations in collaboration with the Passau public prosecutor's office and is checking, among other things, whether the respective users have also distributed such images and videos in addition to owning them.

In this context, the Lower Bavaria police repeatedly point out the “YOUR smartphone, YOUR decision” campaign:

Depending on the age of the owners, recipients, disseminators or performers or depending on the content of the files, various criminal offenses can be committed. Children under the age of fourteen are still under the age of criminal responsibility and cannot act culpably. However, an illegal crime is committed regardless of this and can mean the confiscation of the smartphone, i.e. the removal without replacement.

The user settings of cell phones or the basic settings of apps can promote the distribution of such files (automatic download of media). Once the criminal content is on the smartphone or is distributed, the criminal offenses described above are present. Active action is not always necessary.

“Sexting” phenomenon/meaning
Another phenomenon is known by the technical term “sexting” (sex and texting): This refers to the private exchange of self-created erotic photos/videos via cell phone or the Internet.
Sexting is a modern technology-enabled form of flirting. This applies to children and young people as well as adults. In this way, the files reach the global Internet and can also be used improperly (cyberbullying or blackmail).

Therefore your police request:

  • Talk to your children or students about these dangers.
  • Be a role model when it comes to using smartphones/tablets.
  • Use confidential advice and support services, e.g. B. from the school psychologist, the youth social worker at school (JaS), the youth welfare office or other social bodies or institutions.
