Koblenz public prosecutor's office: October 22, 2020: Alleged sexual abuse in a daycare center / follow-up notification -2071 UJs 28477/20-

The Koblenz public prosecutor's office and the Koblenz police headquarters are currently receiving various press inquiries in connection with the proceedings being conducted here on suspicion of sexual abuse of a child in a Koblenz daycare center on Pfaffendorfer Höhe. The inquiries give rise to the following information:

1. First of all, it should be stated that the Koblenz public prosecutor's office has not become aware of anything that could justify resuming the investigation into the proceedings that were discontinued on October 19, 2020. Because all of the circumstances discussed on social media - which are often misrepresented there - had already been acknowledged as part of the investigation.

2. After the allegations that formed the subject of the case 2071 UJs 28477/20 became known, the Koblenz public prosecutor's office received criminal complaints from two parents in which it was stated that their children were supposed to show more sexualized behavior without this being in the case However, advertisements could be traced back to events in the daycare center. In one case, there was no initial suspicion of a crime – legally defined as “sufficient actual evidence that a crime has been committed” – and in the other case, the investigation is still ongoing.

3. Of course, a public prosecutor's office must respect it if its decisions are viewed critically and this is also articulated. However, it is not acceptable if expressions of opinion have criminal content, ie they contain insults (§ 185 StGB), slander (§ 186 StGB), slander (§ 187 StGB) or threats (§ 241 StGB) or they contain other criminal offenses such as faking a criminal offense (§ 145d StGB) or the threat of criminal offenses (§ 126 StGB). The public prosecutor's office will, if possible, investigate relevant offenses and, if there is an overwhelming probability of conviction, will of course also impose punishment.

The examinations of the contents that have become known so far - these must be weighed up against the constitutionally enshrined right to freedom of expression in each individual case on the basis of very detailed case law from the Federal Constitutional Court - are ongoing, so that no further information can be provided in this regard until further notice.
