When does hatred and agitation become a punishable offense?

Hateful statements are punishable when the limits of free expression are exceeded and the rights of others are violated. Hate online can appear in the form of comments (closed groups, social networks and internet forums), on websites and blogs, in the form of images and through fake accounts.

Laws and social values ​​around the world protect against discrimination: Our basic law stipulates that no one may be discriminated against on the basis of origin, skin color, gender, sexual orientation, religion or disability. Anyone who offends others in the online world can commit a criminal offense. Nobody has to accept or endure hate speech.

What you can do against hate online.

  • Report posts. Inform the operators of a website and request that they be deleted. In social networks there is usually a separate report button for this.
  • Ban haters. In most social networks it is possible to block other users.
  • Expose hate speech. Name the hate speech in your own posting (“This is racist/sexist,” etc.) and make it clear that such content is undesirable. Stay objective!
  • Argue against it. Counter-speech can primarily help to reach silent readers. This means you are not leaving the field to the hate speakers alone.
  • To file charges. If the content of a hate post is criminally relevant, you can report it to any police station.
