Consumer advice center obtains fines

As the Brandenburg Consumer Center reports, providers must adhere to judgments.

In a case brought by the Brandenburg Consumer Center (VZB), the company RSC Aktiv & Vital GmbH from Berlin convicted of correctly informing consumers about the statutory right of withdrawal when concluding contracts at sales events. The provider violated this by omitting his company and address details in a cancellation policy.

After VZB went to court again, the company now has to pay a fine of 5,000 euros to the state.

The subject of the proceedings by the Brandenburg Consumer Center before the Berlin Regional Court in 2016 was that the RSC company had used incorrect cancellation instructions in contracts with consumers for the purchase of mattresses at promotional sales events. The court therefore ordered her to provide correct information about the right of withdrawal in the future.

“Despite the ruling, the RSC later omitted their company and address details from the cancellation policy, thereby making it more difficult for customers to exercise their right to cancel,”

reports lawyer Sabine Fischer-Volk and adds:

“Without appropriate information, the customer doesn’t know where to send the cancellation.”

The Brandenburg consumer advice center submitted a request for information to Deutsche Post AG and filed another lawsuit against the RSC. She obtained a fine of 5,000 euros, which the RSC now has to pay to the state. It is hoped that consumers will no longer be left without the necessary information to send a cancellation in the future.

“In order to protect yourself from the unwanted consequences of concluding contracts on coffee trips, you as a consumer must always remain vigilant: It is important to ensure that specific company information is included in the advertising and later on the contract forms. Consumers should be critical of sellers’ promises and praises. And if you have hastily concluded a contract, you should definitely make use of your right of withdrawal,”
