In the future, consumer decisions will increasingly be influenced by AI-based recommendation systems such as ChatGPT. In order to exclude risks from generative AI for consumers, the planned European AI Act must ensure strong consumer rights and the possibility of independent risk assessment.

“The risk that AI systems will lead to false or manipulative purchase recommendations, reviews and consumer information is high. Artificial intelligence is not always as intelligent as its name suggests,” says Pop. The consequences for consumers can be serious. “It must be ensured that consumers are adequately protected against manipulation, misleading and deception, for example through AI-controlled recommendation systems. Independent scientists must be given access to the systems in order to be able to assess their risks and functionality.”

Strengthen consumer rights vis-à-vis AI operators

Consumers must be able to defend themselves against AI-generated false reports. “We need enforceable individual data subject rights against the operators of AI. People must be given the right to correction and deletion, for example if systems like ChatGPT cause reputational damage.”
