Various customers have problems with the plants they purchased online. Sometimes the wrong plants were delivered, sometimes they came out of the package already wilted. The VZB provides information about the rights consumers have when buying plants online.

Online shopping has increased significantly in popularity during the pandemic. Hobby gardeners are increasingly ordering garden or balcony plants online. In the last few weeks, the VZB has recorded several complaints about this: Consumers found that the plants delivered looked completely different than in the photo or simply did not survive transport. However, the dealers did not want to take the goods back.

The right of withdrawal can help

Wrongly so, because: “Even if the goods do not arrive faulty, when buying online, consumers generally have the right to cancel the contract within 14 days,” says Katarzyna Trietz, legal expert at VZB. The right of withdrawal does not apply to goods that can spoil quickly. “Unlike cut flowers, potted plants are generally not perishable goods,” adds the expert.

If the goods are defective, the warranty law applies

If you receive a different plant than the one ordered or if the plant was received immediately after transport, consumers can invoke the warranty right. “Anyone who receives an incorrect or defective plant should immediately take a photo, complain to the provider and request a replacement,” says Trietz.

But a lot of trust is required, especially with plants. “We advise consumers to look closely at the shipping modalities. What is particularly important is how it is delivered and how the health of the plant is ensured during transport. It is advisable to take a close look at the dealer, especially when ordering for the first time. Since the garden centers are now open again, buying on site in the store is also a good option: “On site you can examine the true condition and appearance of the desired plant and save yourself the hassle of sending it back,” says Trietz.
