Many consumers now book their holidays via travel platforms. But problems always arise: the flight is canceled, the accommodation is dirty or the rental car is not available as booked.
Know your rights regarding vacation
It is often difficult for travelers to enforce their rights. Because both the platform and the travel provider try to shirk responsibility and refer each other to the other. “When it comes to liability issues, it is important to know who the right contact person is,” says Julia Zeller, lawyer at the Bavarian Consumer Center. “When booking your trip, you should pay close attention to the contractual partner and the conditions of the trip.”
Package or individual trip?
The right contact person depends on whether the consumer has booked a package or an individual trip. With a package holiday you get the complete holiday package including transport, hotel, meals and possible tour guide from a single source. If problems arise, you must assert all rights against the tour operator.
However, if you book your flight, accommodation and rental car individually, there is a different contractual partner for each part who you have to contact if you have any problems. The platform used to book is usually only an intermediary and is therefore not responsible for the services. “The type of trip is certainly a matter of taste. However, it is important to make this decision consciously and to find out in advance who the contact person(s) will be if any problems arise,” advises Zeller.
