The Hesse consumer advice center has now sued the Frankfurt am Main regional court for an injunction against the inadmissible health and disease promises of the advertised products as well as the information about the Kingdom of Germany.
“Your Ultimate Healthstore” is what drraw.de says. And further: “Health technologies, superfoods, 100% raw, maximum bioavailability and naturalness directly to your home”. The health promises for the individual products sound promising; various diseases are said to be avoided by taking, for example, “D'etox bitter tea” or “Liposomal Chlorophyll”. However, German law should not apply to the purchase of the products, but rather the law of a “Kingdom of Germany”. The owner of Dr. RAW.
No application to German law
Products sold in Germany may not simply be advertised with health or disease-related claims. “The fact that German law should not apply is a clear violation of elementary consumer rights,” says Philipp Wendt, board member of the Hesse Consumer Center. “Anyone who wants to sell products to consumers living in Germany cannot simply dream up a fantasy state whose law should then apply,” Wendt continued.
Since the owner of Dr. Raw denied the German legal area, it was not possible to reach an out-of-court settlement with him. The Hessen Consumer Center was therefore forced to file a lawsuit.
