The WHO preliminary draft, also known as the “Zero Draft”, is a document that was developed within the framework of the World Health Assembly in order to be able to better respond to future pandemics. It makes it clear that all measures must be consistent with human rights and human dignity. Article 4 particularly emphasizes full respect for human rights.

Likewise, Article 14 emphasizes the need for States to respect and incorporate human rights when introducing pandemic protection measures. While the WHO Director-General has the ability to declare pandemics, this is based on coordination and international health guidelines and not on uncontrolled exercise of power.

The World Health Assembly and the Intergovernmental Negotiating Body play a central role in the formulation of the treaty. The final decision lies with the 194 member states of the WHO. This ensures that no single institution or person is given undue power.
